From tort liability to criminal liability for companies in environmental matters: how should the concept of ecocide be recognized?

Oil spill in the China Sea, citizens' tribunal to judge the impact of Monsanto's activities on human and environmental rights: the concept of ecocide is becoming increasingly prominent in public debate. Defined by English lawyer Polly Higgins as particularly serious destruction of the planet and its resources, ecocide jeopardizes the survival of the human species and other living beings. Does its development in recent years reflect a growing awareness of the climate emergency? How can it be transposed into civil and criminal environmental law, and what are the limitations of the current legal frameworks?
